Appeal against the housing benefit decision in Frankfurt

You can lodge an appeal against a housing benefit (Wohngeld) decision in Frankfurt within one month of notification. The appeal must be in writing; an email is not enough. Address it to the Housing Office (Amt für Wohnungswesen) and explain why the amount, the refusal or the ancillary conditions are wrong. When is an appeal the right route?
An appeal is directed against an administrative act: an award with an amount you consider wrong, a refusal, a revocation or a repayment. Mere requests for more documents are not yet a decision notice against which an appeal would lie. The basis is the written decision notice with information on legal remedies.
If circumstances have changed since the decision, a new application may also be needed. An appeal attacks the old decision; a new application usually takes effect only from the new month of receipt.
Deadline: one month
The appeal period is one month after notification of the decision notice. Notification usually means when it reached you, not the date of the signature at the office. If proper information on legal remedies is missing, a longer statutory period can apply; do not rely on that if the information is on the notice.
The deadline is a cut-off. A late appeal is rejected as inadmissible, even if the reasons would be right on the merits. Sending on the last day by ordinary email does not meet the deadline.
Written form – email is not enough
The appeal must be lodged in writing. That means a signed letter on paper that reaches the authority. An email does not usually meet this form. A phone call or a contact form does not either.
Keep a copy and proof of receipt (recorded delivery or a handing-in receipt). The electronic online application is a different procedure and does not replace an appeal.
What the appeal should contain
State the file number, the date of the decision notice and that you are lodging an appeal. Describe the disputed point: wrong household size, allowances not taken into account, income set too high, wrong gross cold rent, or an incorrect exclusion because of transfer benefits.

- Evidence that proves the error (new or already submitted documents)
- Signature of the person entitled to apply or of an authorised representative
Procedure and effect
The authority re-examines the decision (remedy review). It can grant the appeal in full or in part or refer it to the appeal authority. Whether a repayment duty is suspended follows the general rules of administrative procedure; do not assume that a repayment automatically pauses.
During the appeal you can supply missing documents if that is exactly what the refusal turned on. New facts after the date of the notice often belong in a new application or in a change application, not in the appeal alone.
Typical points of dispute in Frankfurt
Often disputed are the number of countable household members in a shared flat, the exclusion of students “in principle”, the boundary with Bürgergeld, and countable rent up to the maximum for Mietenstufe VI.
The maximum amounts (615 / 745 / 887 / 1,035 / 1,183 euros plus 149 euros for each further member) cap the rent but do not replace the income assessment. After an unsuccessful appeal
If the appeal is dismissed, the information on legal remedies on the appeal decision opens the path to a claim before the administrative court. A further deadline applies, usually one month. Whether a claim makes sense depends on the specific point in dispute.
Independently of the legal remedy you can apply again if the situation has changed – a first application or a renewal. The new application does not automatically cure the old decision, but it secures the start of benefit from the new month.
