Housing benefit for subtenants in Frankfurt

Yes, subtenants can receive housing benefit (Wohngeld) in Frankfurt if they occupy the living space themselves, bear the sub-rent themselves and meet the other conditions. The authority usually requires a subtenancy agreement, the head tenancy agreement and a floor-plan sketch. What is countable is your own sub-rent as gross cold rent, not the head tenant’s rent for the whole flat.

Subtenancy in an expensive city

Subtenancy is widespread in Frankfurt: a room with the head tenant, a furnished apartment, part of a larger flat. In Mietenstufe VI the maximum for one person is 615 euros. Many sub-rents for a room lie below that and can enter in full. Expensive furnished flats exceed the 615 euros; the excess stays uncounted.

Two contracts and the floor-plan sketch

Frankfurt practice typically requires three pieces of evidence of the dwelling: the subtenancy agreement, the head tenant’s head tenancy agreement and a floor-plan sketch. The sketch shows size and names of the rooms and who uses which rooms. Without these documents the authority cannot examine which part of the flat is left to you and whether the stated sub-rent matches it.

You must occupy the space yourself and pay the sub-rent yourself. A subtenancy that exists only on paper does not carry the claim. The rent subsidy otherwise follows the same income rules as for a head tenancy.

Which documents subtenants typically submit

Subtenancy agreement, head tenancy agreement, floor-plan sketch, proof of the last two rent payments, a current rent certificate or change notice, income evidence and identification. The filterable list with the life situation subtenancy is under Documents.

Example: a room as a subtenancy

Example for orientation, not a decision notice: a person rents a room in Sachsenhausen as a subtenancy and pays 495 euros gross cold rent. The maximum for level VI for one person is 615 euros.
