Refusal of the housing benefit application in Frankfurt

A refusal means that the Housing Office (Amt für Wohnungswesen), after assessment, finds no claim to housing benefit (Wohngeld). Common reasons are income that is too high, exclusion because of transfer benefits, lack of entitlement to apply, or incomplete evidence. The refusal notice is an administrative act: you can lodge an appeal in writing within one month. Email is not enough.

What a refusal is in law

The refusal is issued as a written decision notice. It ends the application procedure with a negative result. As long as only documents are being requested, there is not yet a refusal – though an unanswered request can later become a refusal for lack of cooperation.

Read the operative part, the reasons and the information on legal remedies. The reasons must show which facts and which provisions of the Housing Benefit Act (Wohngeldgesetz, WoGG) the authority relied on. Without that check, the next step – putting the application right or an appeal – cannot be chosen usefully.

Typical reasons for refusal

The authority checks the eligibility rules in a fixed order: entitlement to apply, exclusions, then the calculation from rent, income and household. If one point fails, the others often no longer matter.

Income, assets and the maximum amount

A common misconception: if the Frankfurt rent is above the maximum for Mietenstufe VI, that alone does not lead to refusal. The excess is left out of the calculation; the application can still succeed. The maximum amounts are 615, 745, 887, 1,035 and 1,183 euros (one to five people) plus 149 euros for each further member.

What is critical is the total income of all countable household members. The calculation can produce a claim of zero without an exclusion applying. Assets are assessed separately and can cause the claim to fail independently of income.

Transfer benefits and audiences

Anyone who receives Bürgergeld with housing costs taken into account usually receives no housing benefit. Exceptions – such as a pure loan or avoiding the need for assistance – are narrow. Unemployment benefit I does not automatically exclude; details are under Unemployment benefit.

For students, trainees, shared flats and residence and newcomers special checks apply. A refusal in these groups is often a legal question (exclusion in principle), not a pure calculation question.

Formal defects and cooperation

Without readable evidence of the dwelling and the income of all household members the authority cannot make an award. Repeated failure to supply documents after a deadline leads to refusal for lack of cooperation. That is avoidable: the checklist under Documents lists the usual evidence.

What you can do after a refusal

Check whether the reasons match your documents. If only evidence is missing, a new, complete first application or supplying documents with the appeal can help. If you consider the reasons wrong, an appeal is the formal legal remedy.

  • Note the deadline: one month after notification of the decision notice
  • Lodge an appeal in writing; email is not enough
  • Enclose evidence that clarifies the disputed point
  • If your life situation has changed, consider a new application in parallel

New application or appeal?

An appeal attacks the decision already taken and aims at its revocation or amendment. A new application starts a new assessment from the new month of receipt. Months between the refusal and a new application are not paid retrospectively if no appeal keeps the old decision open.
