Transfer benefits that displace housing benefit or run alongside it

Housing benefit (Wohngeld) is subsidiary if another benefit already covers housing costs. Bürgergeld and basic income support with housing costs usually exclude the claim. Single students and trainees are often excluded if BAföG or vocational training allowance (BAB) is available in principle. Unemployment benefit I, child benefit, maintenance or a pension do not by themselves block a claim; they are counted as income. The housing-benefit authority examines the exact boundary.
Subsidiarity: housing costs should not be paid twice
The Housing Benefit Act separates benefits that cover living costs including housing from those that only raise income. If the rent is already inside a priority benefit, there is no room for the subsidy. If a payment only counts as a receipt, housing benefit runs alongside it – reduced by that amount.

Benefits that usually exclude a claim
The excluding circle includes in particular:
- Bürgergeld under Book II of the Social Code, if housing costs are taken into account
- Basic income support in old age and in the case of reduced earning capacity, and assistance towards living costs under Book XII of the Social Code with housing costs
- Basic benefits under the Asylum Seekers’ Benefits Act, insofar as they cover accommodation
- BAföG or vocational training allowance in principle for single students and trainees
Benefits that only raise income
Other payments leave access to housing benefit open, but flow into income:
- Unemployment benefit I
- Pensions from the statutory pension insurance, occupational and survivors’ pensions
- Child benefit
- Parental allowance, insofar as it is countable for housing-benefit purposes
- Maintenance and advance maintenance payments
- Sickness benefit and comparable wage-replacement benefits
Bürgergeld, basic income support and switching to the subsidy
As long as the jobcentre or the social-welfare office covers the actual housing costs, housing benefit is regularly blocked. A switch comes into consideration if earnings, a pension or maintenance go far enough that, with housing benefit, there would no longer be a need for assistance. Then the subsidy can replace the priority benefit rather than supplement it.
The check is case-specific. Anyone who has only received a loan for the rent does not automatically fall under the exclusion. Details and typical transitions are under Bürgergeld.
Training, study and “in principle”
For single students and trainees it does not matter whether BAföG or BAB is actually paid. What matters is whether a claim would be available in principle. A refusal solely because of the parents’ income or assets does not remove this exclusion.

Mixed households and partial benefits
If only some of the occupants receive an excluding benefit, the rest of the household can remain eligible for housing benefit – with their own share of the rent and their own income. The split follows actual use and the household members, not only the account to which the jobcentre pays.

What the application must make visible
Every current benefit belongs in the application, including refusal or termination notices. The authority can recognise the exclusion or a mere income count only from these documents. The checklist is under Documents.
A later end of Bürgergeld or the end of studies can support a new first application. If housing benefit is already running, a new transfer benefit belongs in a report to the authority and in the renewal.
