Separation and housing benefit in Frankfurt

A separation changes the number of household members and often total income. Anyone who stays in the dwelling reports that to the Housing Office (Amt für Wohnungswesen). Maintenance generally counts as income. Anyone who henceforth keeps house alone with a child can claim the single-parent allowance. If the entire household splits, the previous awards end; each new dwelling needs its own application.

What changes for housing-benefit purposes

Housing benefit hangs on three figures: the countable household members, total income and the countable rent or housing burden. After a separation fewer people live in the dwelling, or two households arise at two addresses. Both are a change that you must report.

As long as both partners still live in the same dwelling and keep house jointly, it often remains one household. Only the move-out or demonstrably separate housekeeping leads to a new assessment. The general rules are under Duty to notify.

Who stays in the dwelling

If one person – often with children – stays in the previous dwelling, the authority reassesses the claim. The income of the person who has moved out falls away; maintenance, child benefit and your own earnings take its place. The rent of the whole dwelling can exceed the maximum for the smaller household; the excess stays uncounted.

Maintenance as income

Maintenance payments for you or the children belong to housing-benefit income as soon as they flow or are effectively titled and enforceable. That applies to child maintenance as to separation or post-marital maintenance. Mere announcements without payment can be assessed differently; the office asks for evidence.

Single parent after the separation

Anyone who raises at least one child alone and meets the conditions can use the single-parent allowance in the housing-benefit calculation. That lowers countable income. Whether you count as a single parent follows from actual cohabitation, not from marital status alone.

Two dwellings, two applications

If the other person moves into their own dwelling in Frankfurt, two households arise. Each side applies for housing benefit for their own dwelling if the eligibility rules are met. The previous joint decision notice does not carry both new dwellings.

If the new dwelling lies outside Frankfurt, competence for that person changes. Within the city the same office remains responsible, but with separate cases. A move of the entire previous household in two directions ends the old award completely.

What you report to the office

State the date of separation and of the move-out, who stays in the dwelling, which children are registered and live where, and which maintenance arrangement applies. If maintenance later changes or a child moves, that must be reported again.

After the decision a new or adjusted decision notice with its own award period applies. Before it ends you submit the renewal in time. If there is a dispute about the amount or a refusal, an appeal remains the formal route.
